Sylvester Stallone knocked out a lawsuit

Sylvester Stallone knocked out the author who claimed to be the real writer behind The Expendables.

U.S. District Judge Jed Rakoff in Manhattan on Monday dismissed the lawsuit filed last October by Marcus Webb, who said the movie was "strikingly similar and in some places identical" to his own work, "The Cordoba Caper." He also said that it is similar from the opening sequence to the plot to the character of the villain.

Webb had sought damages for alleged copyright infringement, and a ban on infringement in any sequel by Stallone; co-author David Callaham; Nu Image Films, which produced the movie; and Lions Gate Entertainment Corp, which distributed the movie in the United States.

Stallone's lawyers pointed out that Webb wrote his script after Callaham had already written three drafts of the screenplay and that Webb had no information that Stallone or Callaham had ever seen Cordoba.

In oral argument, Rakoff focused on whether the screenplays were "strikingly similar."

The judge grant a motion to dismiss because the alleged similarities were merely ideas and that the overall concept and feel of the two works was vastly different.

"The Expendables" was released on August 13, 2010. Stars included in the film were Stallone, Jason Statham, Jet Li, Dolph Lundgren, Bruce Willis, and Arnold Schwarzenegger.

A sequel, "The Expendables 2," is scheduled for release on August 17.

'Brave' and Princess Merida Beat Up the Boys at Box Office: $66.7M

"Brave" and its red-tressed heroine Princess Merida had the box office all bowed-up this weekend, posting a $66.7 million debut.

"This is Pixar doing what Pixar does," Disney's executive vice-president of exhibition Dave Hollis told TheWrap Sunday. "They have created very high expectations and they've delivered." Audiences agreed, giving the movie an "A" CinemaScore.

It's the 13th consecutive No. 1 opening for Pixar, and marks the summer's second major box-office score for Disney with a film from an in-house studio partner. Marvel's superhero mashup "The Avengers" posted the biggest box-office bow in U.S. history in May and has gone on to make more than $1.4 billion worldwide.

"The similarity between the two is that they were both great movies," Hollis said.

"Brave" posted the second-best June opening for an animated film ever, behind only 2010's "Toy Story 3," which bowed to $103 million for Pixar in 2010.

Audiences skewed female at 57 percent and 55 percent were under 25 years of age. Families made up 66 percent of the crowds, couples 22 percent and teens 12 percent. Concerns that the female heroine would keep young males away vanished.

"Being brave and chasing your fate are themes that transcend gender and age," Hollis said. "The only way you get the kind of numbers we did is to resonate with families and adults, and Pixar can do that."

"Brave" blew away the competition. "Madagascar 3: Europe's Most Wanted," for two weeks running the No. 1 movie worldwide, finished a distant second with $20.2 million. The two other movies opening wide this week, Fox's "Abraham Lincoln: Vampire Hunter," and Focus Features' "Seeking a Friend for the End of the World," disappointed with $16.5 million and $3.8 million respectively.

"Brave" benefited from a massive rollout. It's 4,164 locations were the most ever for a Pixar film and 2,790 of those screens were 3D and delivered 34 percent of the receipts. The movie's per-screen average was $16,028.

The opening for "Brave" matches that of Pixar's last release, last summer's "Cars 2," which opened to $66 million and went on to make $191 million and $560 million worldwide. Disney would like to see numbers closer to those posted by "Toy Story 3," which grossed more than a billion dollars globally in 2010.

"Brave" opened in 10 overseas territories this weekend -- about 17 percent of the foreign market -- and took in another $13.5 million. The studio plans a staggered overseas rollout, in part to stay away from European soccer and other studios' animated offering.

Fox had to be disappointed in its $70-million genre-monster mashup "Abraham Lincoln: Vampire Hunter." The film, based on a New York Times best-seller by Seth Grahame-Smith, drew just a "C+" CinemaScore from audiences, and the weak word-of-mouth hurt as the grosses declined each day.

Box office report: 'Madagascar 3' earns $35.5M, more than 'Rock of Ages' and 'That's My Boy' combined

A couple of high-profile openers couldn’t force the animals of Madagascar 3: Europe’s Most Wanted into their cages. The animated comedy topped the box office once again this weekend, while Rock of Ages and That’s My Boy delivered majorly disappointing debuts.

Dreamworks’ $145 million effort Madagascar 3 roared a second time following its $60.3 million start. The CG-animated film dipped 41 percent to $35.5 million this frame, which was better than the second weekend decline of its predecessor, Madagascar: Escape 2 Africa, which fell by 45 percent and had earned a slightly softer $116.9 million at the same point in its run.

Madonna Flashes Nipple Onstage In Turkey

While performing “Human Nature” from 1994’s Bedtime Stories, Madonna gave a brief striptease culminating in a clearly purposeful flash of her right nipple.

Lady Gaga retaliates against Madonna

LA: Lady Gaga retaliates against Madonna’s recent statement that the young pop star ripped off Queen of Pop’s single Express Yourself  for her Born This Way.

Lady Gaga is not happy with the way the 53-year-old singer has been taking jibes at her. In a rather abrupt break during her concert in Auckland, New Zealand last Thursday, she ranted in front of her fans about what appeared to be an indirect reply to Madonna.

“It sometimes makes people feel better about themselves to put other people down or make fun of them or maybe make mockery of their work. And that doesn’t make me feel good at all. That just makes me feel like I’m not being a good human being… I don’t even want to fight back because it’s more important to me to keep writing music,” Gaga said in the middle of her performance of Hair.

“Because that’s really all I care about, is the music… things are really different than they were 25 years ago, and that’s what makes Born This Way so relevant for me. We’re socially in a different place and it’s OK, we don’t have to all slice and hate each other anymore,” she added.

Recently, Madonna mashed up Gaga’s hit single ‘Born This Way‘ with her own 1989 song Express Yourself during the Tel Aviv concert of her MDNA tour. At the end of the performance, she shouted to her fans, She’s not me!,
without mentioning who her target was.

Things were not so bad between the two stars. Initially, Madonna was happy with Gaga’s claims that she inspired her but their friendship turned sour after ‘Born this way‘ release.

Asked about her thoughts on the song, Madonna had said, “I thought it was reductive. I thought ‘What a wonderful way to redo my song.’ I mean, I recognized the chord changes. I thought it was… interesting.”

Addressing the controversy, Gaga had said, “The only similarities are the chord progression. Just because I’m the first artist in 25 years to think of putting it on Top 40 radio, it doesn’t mean I’m a plagiarist, it means that I’m smart.”

Police recover Guns N' Roses frontman Axl Rose's stolen jewellery

Police have arrested a woman in connection with a robbery which saw over $200,000 worth of jewellery stolen from Guns N' Roses frontman Axl Rose in Paris last night (June 5).

The singer was at a private gathering after his band's show at the French capital's Bercy Stadium when the theft of three gold-and-diamond necklaces occurred.

The woman, a model, returned the necklaces today (June 6) to police and was subsequently arrested, reports AFP. She claims not to know how she ended up leaving with the jewellery.

According to a spokesman for the band, it did not appear that Rose was wearing the necklaces at the time. He also said that Axl was said to be "fuming" after the theft.

Guns N' Roses completed their troubled UK arena tour on Friday (June 1), ending their run of shows on a sour note after being pelted with money and pint glasses. As well as this, the band have drawn intense criticism for their frequent late starts, often taking to the stage after 11pm.

As previously reported by NME, fans who turned out for the gigs wearing clothes bearing the image of the band's former guitarist were turned away by security - and were only allowed in after removing the offending item of clothing.

The band are touring across Europe for the next two weeks and are scheduled to play in Moenchengladbach, Germany, on Friday (June 8).

Axl Rose was robbed $200,000

PARIS (AP) — Police say Guns N' Roses front man Axl Rose was robbed of three gold-and-diamond necklaces worth some $200,000 after the hard rock band's concert in Paris.

A Paris police spokesman said Wednesday that the lead singer of the Rock and Roll Hall of Fame-inducted band was fuming after the theft during a private gathering after the band's show at Bercy stadium the previous night.

Judicial police have opened an investigation but the spokesman said it didn't appear Rose was wearing the necklaces at the time. The spokesman spoke on condition of anonymity because of office policy.

The group's website says they are scheduled to play in Moenchengladbach, Germany, on Friday before returning to France as part of a tour of Europe and Israel that runs through July 22.
